Delchev & Partners represent Filton, a leading producer of accessories for vacuum cleaners, on a dispute with one of its distributors. The distributor registered as a trademark the distinctive sign which Filton has been using in its business for the past two decades. Delchev & Partners currently represent Filton as a claimant on cases before the civil court, the Bulgarian patent office and the Bulgarian Commission on Protection of Competition regarding respectively a bad faith application of a trade mark, its invalidation and a possible unfair competition. In addition to that Delchev & Partners successfully obtained from the civil court an injunctive measure which is very rare for Bulgaria, ie an injunction imposed on the distributor not to use the trade mark that it has already registered.
