Distance contract 

The ECJ ascertained that it has already held that the Regulation does not necessarily require the consumer contract to be concluded at a distance1.

The application of the Regulation, therefore, cannot be subject to whether the contract was concluded at place at the trader’s undertaking, as in the present case, or via the commercial website used by the trader.
