In 2012 an Israeli tour operator, used the services of a major Bulgarian airline carrier to ensure the provision of an aircraft and performance of flights between Bulgaria and Israel. In the middle of 2012 there was a terrorist act in one of the Bulgarian air ports.
Delchev & Partners represents the Bulgarian airline carrier in arbitration proceeding initiated by the Israeli tour operator. The tour operator’s claim relates to the terrorist act and its effect on the flights between Bulgaria and Israel as a force majeure event. The case also concerns very complicated and specific matters related to the overall process of slot co-ordination and obtaining of permissions for civil flights under the International Air Transport Association’s rules and calendar.
